Акт судовых замеров.
Помимо документации, которая готовится представителями терминала и судовым агентом для оформления коммерческих и юридических аспектов перевозки, капитан судна с целью максимального обеспечения защиты интересов судовладельца готовит пакет судовых документов. Одним из наиболее важных судовых документов является «Акт судовых замеров» (Ullage Report или Sounding Report). Очень важно, чтобы при составлении Актов замеров, независимый сюрвейер и грузовой помощник согласовывали методы подсчета груза и полученные результаты. Как правило, подписи грузового помощника и сюрвейера на актах замеров являются юридическим подтверждением правильности результатов подсчета груза. Но, поскольку акт замеров, подписанный без оговорок, также как и коносамент, возлагает всю ответственность на перевозчика, грузовому помощнику нужно учитывать целый ряд факторов, с тем, чтобы определить, какую оговорку необходимо сделать на акте замеров, представленном сюрвейером. Во многих компаниях предусмотрена стандартная форма оговорки, которую должен делать грузовой помощник на акте замеров сюрвейера: «Только за объём и температуру». Но тут же возникает целый ряд вопросов:
Дело в том, что грузовой помощник не несет ответственность за то, насколько точно было произведено определение пустот в грузовых танках и температуры груза, если в ходе замеров использовался инструмент сюрвейера. Он также не несет ответственности за ошибки, которые мог допустить сюрвейер при пользовании мерительными таблицами. Поэтому юридически правильными будут оговорки примерно такого типа: «Только в получении» (For Receipt Only) или «Только в ознакомлении» (For Acknowledge Only). В случае возникновения каких либо претензий со стороны грузополучателя в порту выгрузки, наличие таких оговорок на акте замеров сюрвейера (береговых замеров) дает страховщикам и адвокатам судовладельца большую свободу действий по защите его интересов. Но акт судовых замеров, составленный грузовым помощником, должен быть подписан сюрвейером без внесения оговорок.
Акт учета стояночного времени (Time Sheet)
Детальная запись о времени, затраченном судном на стояночные операции в
порту ( погрузки или выгрузки) готовится обычно судном, хотя, в некоторых
случаях грузоотправитель может независимо от судна вести учет стояночного
времени в порту. Судовой агент согласовывает акт учета стояночного времени
с представителями терминала для того, чтобы представить судовладельцу и
грузоотправителю уже согласованный документ, в котором указаны все
основные моменты, касающиеся проведения грузовых операций, задержки,
ожидания и пр. Акт позволяет распределить затраты на обработку судна в
порту между участниками чартера. Ниже приведена примерная форма «Акта учета стояночного времени»
